As an integral part of its new policy on the export of minerals, the Ministry of Energy and Mineral Resources(“Ministry”)has issued Regulation No. 7 of 2017 on Procedures for the Determination of Benchmark Prices for the Sales of Metal Minerals and Coal(“Regulation 7/2017”).Regulation 7/2017 is an implementation of Articles 85 (4) and 111 of the recently passed Government Regulation No. 1 of 2017 on the Fourth Amendment to Government Regulation No. 23 of 2010 , which required the government to set out procedures relating to the determination of benchmark sales prices for metal minerals and coal.Prior to the issuance of Regulation 7/2017, these same matters were regulated under Ministerial Regulation No. 17 of 2010 (Regulation 17/2010).Applicability of Benchmark PricesMetal-minerals and coal products can be sold by companies (collectively referred to as“Businesses”) which have already secured the following documents:
