The government has issued Government Regulation No. 20 of 2017 on the Control of the Import and Export of Goods Resulting from Violations of Intellectual Property Rights (“Regulation 20/2017”).Regulation 20/2017 serves as an implementation of Article 64 (1) and (2) of Law No. 10 of 1995 on Customs, which was amended by Law No.17 of 2006 . These articles required further provisions to be set out relating to the control of imports and exports of goods resulting from violations of intellectual property rights (“Illegal Goods”). [1] In essence, Regulation 20/2017 sets out two type of measures relating to the control of Illegal Goods, specifically: [2]
