In 1999, Indonesia’s House of Representatives (Dewan Perwakilan Rakyat– “ DPR ”) enacted Law No. 5 of 1999 on the Prohibition of Monopolistic Practices and Unfair Business Competition, which was subsequently amended several times, most recently by Law No. 1 of 2026 on Penal Adjustment (collectively referred to as “ Law 5/1999 ”). As its title suggests, Law 5/1999 addresses a wide array of types of agreements and activities that have been prohibited in order to prevent monopolistic practices or unfair business competition emerging among business actors.
