Decision of the MK No. 282/PUU-XXIII/2025: Provisions Criminalizing Insults against the Government and State Institutions Declared Unconstitutional

On28 August 2026,Indonesia’s Constitutional Court (Mahkamah Konstitusi– “ MK ”) handed down Decision No. 282/PUU-XXIII/2025 (“ Decision 282/2025 ”) in response to a petition for a judicial review of Law No. 1 of 2023 on the Criminal Law Code (Kitab Undang-Undang Hukum Pidana– “ KUHP ”) as amended by Law No. 1 of 2026 on Criminal Adjustment (collectively referred to as “ KUHP ”). The petition was filed by several petitioners (“ Petitioners ”) and officially registered by the MK Registrar’s Office on 30 December 2025. [1]
