Through the issuance of Constitutional Court Decision No. 85/PUU-XI/2013 , Law No. 7 of 2004 on Water Resources has now been formally declared null and void. As a result, the regulation and management of water resources within Indonesia has now reverted to Law No. 11 of 1974 on Water (“1974 Law”).In a bid to update the now obsolete provisions which are set out under the 1974 Law and therefore provide greater legal certainty for the water industry, the House of Representatives (“House”) is currently in the process of deliberating the Draft Bill on Water Resources (“Draft Bill”). The Draft Bill encompasses a total of 50 articles, which together make up a comprehensive umbrella of provisions which relate to the utilization of water resources.The Draft Bill specifically addresses the following matters:
