In line with the development of sustainable plantations and in order to take account of economic, socio-cultural and ecological aspects, as mandated under Law No. 39 of 2014 on Plantations, as amended by Regulation of the Government in Lieu of Law No. 6 of 2023 (“ Law 39/2014 ”), the president previously issued Regulation of the President No. 44 of 2020 on the Indonesian Sustainable Palm-Oil (“ ISPO ”) Certification System (“ Regulation 44/2020 ”) which, in essence, addresses a wide range of matters that specifically relate to ISPO certification, including its implementation, granting and available administrative sanctions (see: “ Mandatory ISPO Certification for Palm-Oil Businesses ”). In order to build upon the above-mentioned regulatory frameworks, the Minister of Agriculture (“ Minister ”) subsequently introduced Regulation of the Minister No. 38 of 2020 on the Implementation of the Indonesian Sustainable Palm-Oil Certification System (“ Regulation 38/2020 ”) in the same year, which is used as a technical reference in relation to the implementation of the ISPO certification system and which sets out various criteria, procedures and certification costs associated with ISPO certification.
