The Indonesian Government has finally issued Regulation of the Government No. 90 of 2019 on Procedures for Applications, Examinations and Settlements of Appeals at the Trademarks Appeal Commission (“ Regulation 90/2019 ”), in accordance with the mandate originally set under Law No. 20 of 2016 on Trademarks and Geographical Indications (“ Trademark Law ”). [1] In essence, Regulation 90/2019 sets out further provisions which address trademark appeals and the Trademarks Appeal Commission (“ Commission ”), including the Commission’s new authority to make recommendations in relation to the deletion of registered trademarks.
