With the aim of expediting the various processes involved in export clearance by accelerating the checking of physical goods and documents, [1] The Minister of Finance (“Minister”) has issued Regulation No. 86/PMK.04/2016 on the Second Amendment to Minister of Finance Regulation (“Amendment”) No. 214/ PMK.04/2008 on the Collection of Export Duties (“Regulation”). [2] The Amendment primarily revises provisions relating to the following matters: a) Types of goods which are exempt from export duty; b) Procedures for the mandatory physical checking of export goods; and c) Procedures for the formulation of export duty.The Amendment is of relevance to all exporters.Exempt GoodsIn essence, exporters who seek to export their goods to other countries will be subject to fees in the form of export duty. [3] Such export duty is to be stipulated by the Minister after he has received a recommendation from the Minister of Trade and/or other relevant officials. [4] Additionally, the Minister also has the authority to stipulate various goods which are exempt from export duty, and these are as follows: [5]
