Govt. Updates Legal Framework for the Preparation and Determination of Mining Areas

As mandated through the issuance of Law No. 3 of 2020 on the Amendment to Law No. 4 of 2009 on Minerals and Coal Mining (“ Law 3/2020 ”), [1] the government has decided to issue various updated prerequisites that apply to Mining Areas (Wilayah Pertambangan– “ WP ”) through the issuance of Regulation of the Government No. 25 of 2023 on Mining Areas (“ Regulation 25/2023 ”), which has been in force since 5 May 2023. [2] The issuance of Regulation 25/2023 has consequently resulted in the repeal and replacement of previous frameworks on WP, as specifically addressed under Regulation of the Government No. 22 of 2010 , which bore the same title as Regulation 25/2023 (“ Regulation 22/2010 ”).
