In the wake of various problematic cases relating to its implementation, calls have emerged from various parties to revise Law No. 11 of 2008 on Electronic Information and Transactions and its amendment (collectively referred to as the “ ITE Law ”). [1] Currently, as said revision remains in the pipeline, the Minister of Communication and Informatics, the Attorney General and the Head of the Indonesian Police Force have issued Joint Decree No. 229 of 2021, No. 154 of 2021 and No. KB/2/VI/2021 (“ Joint Decree ”), which sets out guidelines that specifically address the implementation of several articles that deal with actions that are prohibited under the ITE Law, specifically: Articles 27, 28, 29 and 36.
