Indonesias Latest E-Commerce Regulation Expands Platform Liability Through Fee Transparency, Domestic Product Prioritization, and AI Labeling

The Minister of Trade (“ Minister ”) has issued Regulation No. 19 of 2026 on the Organization of Business in Trade Through Electronic Systems (Perdagangan Melalui Sistem Elektronik– “ PMSE ”) (“ Regulation 19/2026 ”), which has simultaneously repealed and replaced the previous framework of Regulation of the Minister No. 31 of 2023 on Business Licensing, Advertising, Guidance and Supervision for PMSE Business Actors (“ Regulation 31/2023 ”). [1] The Minister has further confirmed that Regulation 19/2026 was formulated in alignment with the policy framework currently being developed by the Minister of Micro, Small, and Medium Enterprises to prevent regulatory overlap.
