Irrigation - Implementing Regulation

The Government has issued RegulationNo. 20 of 2006to facilitate the implementation of Article 41 ofLaw No. 7 of 2004on Water Resources (Water Law). This Regulation should be classified as an implementing regulation and highlights one of the anomalies in the legislation drafting system in Indonesia based onLaw No. 10 of 2004on Legislation Drafting, that is; primary laws are often generic in nature and are consequently heavily dependent on sub-ordinate legislation in order to be effectively and efficiently enforced. The time lag between primary and sub-ordinate legislation often results in legal uncertainty with respect to how the basic primary provisions are to be interpreted and enforced.
