Law No. 5 of 1999 on the Prohibition of Monopolistic Practices and Unfair Business Competition (“ Law 5/1999 ”) [1] does not explicitly require business actors to formulate business-competition compliance programs. However, as business actors are generally required to comply with Law 5/1999, said programs are expected to become an integrated part of business actors’ policies. [2] In order to assist business actors in the formulation of said compliance programs, the Business Competition Supervisory Commission (Komisi Pengawas Persaingan Usaha– “ KPPU ”) issued a set of guidelines back in 2016.
