KPPU Regulation: Guidelines on Article 20 (Predatory Pricing)

The Business Competition Supervisory Commission (“Commission”) has issued Regulation No. 6 of 2011 on the Guidelines for Article 20 of Law No. 5 of 1999 on the Prohibition on Monopolistic Practices and Unfair Business Competition (“Regulation”).The purpose of the Regulation is to provide a clear understanding of predatory pricing as regulated under Article 20 of Law No. 5 of 1999 (“Law 5/1999”) and prevent interpretations of the Regulation that are too broad.
