Minimum 5% Allocation for Centralized Allotment and Three-Month Due Diligence Requirements Soon Introduced for EBUS Offerings

The Financial Services Authority (Otoritas Jasa Keuangan– “ OJK ”) is currently completing work on a new Draft Regulation (“ Draft Regulation ”) of the OJK Board of Commissioners on the Implementation of Electronic Public Offerings of Debt Securities and/or Sukuk (Efek Bersifat Utang dan/atau Sukuk– “ EBUS ”). If this Draft Regulation ultimately comes into force, then it will serve as an implementing framework to Regulation of the OJK No. 41/POJK.04/2020 (“ Regulation 41/2020 ”) and will specifically address the governance of electronic public offerings of EBUS.
