MK Decision No. 273/PUU-XXIII/2025: Unused Data Quotas Can No Longer Simply Expire Without User Protection Options

On23 July 2026,Indonesia’s Constitutional Court (Mahkamah Konstitusi– “ MK ”) handed down Decision No. 273/PUU-XXIII/2025 (“ Decision 273/2025 ”) in response to a petition for a judicial review of Law No. 36 of 1999 on Telecommunication, as amended by Government Regulation in Lieu of Law No. 2 of 2022 on Job Creation (collectively referred to as “ Law 36/1999 ”). The petition was filed by two petitioners (“ Petitioners ”) and officially registered by the MK Registrar’s Office on 26 December 2025. [1]
