MK Decision No. 3/PUU-XXII/2024: Education Fees Charging Permitted for Private Schools, Financial Relief Required in Return

On27 May 2025,Indonesia’s Constitutional Court (Mahkamah Konstitusi– “ MK ”) handed down Decision No. 3/PUU-XXII/2024 (“ Decision 3/2024 ”) in response to a petition for a formal judicial review of Law No. 20 of 2003 on the National Education System (“ Law 20/2003 ”) that had originally been filed on 11 December 2024 by Network Education Watch Indonesia (an organization that is commonly known as New Indonesia) in conjunction with several individuals (collectively referred to as “ Petitioners ”).
