OJK Finally Introduces Regulatory Framework for Disgorgement and the Disgorgement Fund Within the Capital-Market Sector

The Financial Services Authority (Otoritas Jasa Keuangan– “ OJK ”) has finally issued the long-awaited [1] Regulation No. 65/POJK.04/2020 on the Return of Unlawful Profits and the Compensation Fund for Investor Losses Within the Capital-Market Sector (“ Regulation 65/2020 ”). This new regulation will serve as a set of guidelines for the implementation of remedial actions and the management of funds aimed at compensating losses that are sustained by investors as a result of illegal activities within the capital-market sector.
