OJK Strengthens Health Insurance Framework: Insurance Companies May Implement Policyholder Risk-Sharing Capped at 5% of Total Claims

The Financial Services Authority (Otoritas Jasa Keuangan– “ OJK ”) has issued Regulation No. 36 of 2025 on the Strengthening of the Health Insurance Ecosystem (“ Regulation 36/2025 ”), which is set to come into force on 22 March 2026. [1] As its title suggests, Regulation 36/2025 has been introduced in an effort to strengthen the national health insurance ecosystem and ensure that an adequate balance of benefits is achieved between policyholders, insured parties and participants through improved governance and consumer protection. [2]
