Procedures for the Submission of Data and Information to the PPATK by Public and Private Institutions

The government is continuing in its efforts to combat corruption-related crimes, this time around by issuing Government Regulation No. 2 of 2016 (“2016 Regulation”)on Procedures for Submitting Data and Information by Government and/or Private Institutions for the Purpose of Preventing and Eradicating Money Laundering.Through the 2016 Regulation, the government has set out the various procedures and requirements through which public and private institutions covering lawyers, notaries, public-accountants associations, the Indonesian Central Securities Depository, and Securities Underwriting Clearing Indonesia, can submit several different types of information or data to the Indonesian Financial Transaction and Analysis Centre (Pusat Pelaporan dan Analisis Transaksi Keuangan–“PPATK”). The submitted information and data will be then used by the PPATK for the purpose of investigating any suspicious transactions which could lead to criminal offences being committed.The 2016 Regulation is of relevance to the public and government institutions, as well as to lawyers, notaries, public-accountants associations, the Indonesian Central Securities Depository, and Securities Underwriting Clearing Indonesia (together referred to as “Private Institutions”).Information and Data Types and Request ProceduresThe PPATK is allowed to request that Public and Private Institutions provide or open up access to 11 types of information and data, as listed in Article 3 of the 2016 Regulation, covering: [1]
