Provisions and Mechanism for Determinations of the Right to Cultivate

The Ministry of Agrarian Affairs and Spatial Planning (“Ministry”)/ Head of the National Land Agency (“BPN”) has issued Regulation No. 7 of 2017 on Provisions and Procedures for the Determination of the Right to Cultivate (“Regulation 7/2017”). This new regulation aims to provide a comprehensive set of guidelines for determining the right to cultivate (Hak Guna Usaha -“HGU”), an area which was previously regulated under a number of separate regulations, (collectively referred to as “Previous Regulations”), including: [1]
