In a bid to provide better protection for patent holders during the implementation of compulsory patent licensing (“ Compulsory License ”), the Minister of Law and Human Rights (“ Minister ”) recently issued Regulation No. 30 of 2019 on Procedures for the Granting of Compulsory Patent Licensing (“ Regulation 30/2019 ”). [1] Regulation 30/2019 now explicitly clarifies that the granting of compulsory patent licensing does not prevent patent holders from exercising their rights in accordance with the relevant laws and regulations.
