In order to implement a firm approach to enhancing accessibility to public transportation facilities for persons with special needs, the Ministry of Transportation (“ Ministry ”) has issued Regulation No. PM 98 of 2017 on the Provision of Accessibility to Public-Transportation Services for Consumers with Special Needs (“ Regulation 98/2017 ”).Prior to the issuance of Regulation 98/2017, these same matters were already regulated under Ministry Decree No.KM. 71 of 1999 on Accessibility to Transportation Facilities and Infrastructure for Persons with Disabilities and Sicknesses (“ Regulation 71/1999 ”), which has now been deemed no longer able to meet the current needs of public transportation consumers with special needs (“ Special Needs Passengers ”).Accessibility to Public Transportation Facilities and InfrastructurePublic transportation operators (“Public Transportation Operators”) , which include the government and Indonesian companies, are required to provide appropriate facilities and infrastructure which are accessible to Special Needs Passengers. [1] The various accessibility facilities and infrastructure that must be provided by the Operators Public Transportation Operators for the purpose of accommodating Special Needs Passengers are outlined in the following table: [2]
