The Ministry of Finance (“ Minister ”) has issued Regulation No. 170/PMK.08/2018 (“ Amendment ”), which amends Regulation of the Minister No. 223/PMK.011/2012 on the Provision of Feasibility Support in the Form of Partial Construction Costs for Infrastructure Provision Projects under Public-Private Partnership Schemes (“ Regulation 223/2012 ”). [1] In essence, the Amendment redefines a number of provisions which relate to the feasibility support disbursement mechanism for Public-Private Partnership (“ PPP” ) infrastructure projects, as well as the responsibilities of various government-related parties.Disbursement Procedure for Feasibility SupportAs background information, in order for any feasibility support to be disbursed, the relevant Signing Business Entities for Partnership Agreement (Badan Usaha Penandatangan Perjanjian Kerja Sama –“ Business Entity ”) must follow several steps, including the submission of a Feasibility Support Payment Bill (“ Bill ”) and verification by the relevant government-related parties.
