The Minister of Finance (MoF) recently issued RegulationNo.100/PMK.02/2006(Regulation), which removes the tariffs previously levied against coal exports under RegulationNo. 95/PMK.02/2005(Reg. 95) as amended by Regulation No. 131/PMK.010/2005 (Reg. 131). The necessity for this is found and is based on Supreme Court (MA) Decision No. 07P/HUM/TAHUN 2006 of 21 July 2006. The MA decision cancelled at law Reg. 95 and Reg. 131 and further instructed the MoF to repeal the Regulations.
