Requirements for WIUP or WIUPK Extension Requirements Simplified! Minimum Production Period Lowered to Two Years

In 2023, the Minister of Energy and Mineral Resources (“ Minister ”) has issued Decree No. 375.K/MB.01/MEM.B/2023 (“ Decree 375/2023 ”) on the Guidelines for the Submission, Evaluation and Processing of the Expansion of Mining Business License Area (Wilayah Izin Usaha Pertambangan– “ WIUP ”) and Special Mining Business License Areas (Wilayah Izin Usaha Pertambangan Khusus– “ WIUPK ”) for Mineral and Coal Conservation (“ Conservation ”). As the title suggests, Decree 375/2023 sets forth the applicable mechanism for existing holders of Mining Business License (Izin Usaha Pertambangan– “ IUP ”) and/or Special Mining Business Licenses (Izin Usaha Pertambangan Khusus– “ IUPK ”) (collectively referred to as “ Permit Holders ”) to ultimately secure an expansion of their originally allocated WIUP and/or WIUPK (collectively referred to as “ Mining Areas ”).
