The Ministry of Communication and Informatics (“Ministry”) has issued Regulation No. 20 of 2017 on Selection Procedures for Users of the 2.1 GHz Radio-Frequency and the 2.3 GHz Radio-Frequency Bands for the Organization of Mobile Cellular Networks in 2017 (“Regulation 20/2017”).Regulation 20/2017 serves as an implementation of Article 11 of Ministry Regulation No. 4 of 2015 [1] on Operational Provisions and Licensing Procedures for the Utilization of the Radio-Frequency Spectrum, which required procedures for the selection of users of the 2.1 GHz radio-frequency and the 2.3 GHz radio-frequency bandsto be further regulated. [2] Regulation 20/2017 encompasses comprehensive selection procedures for the determination of users of the 2.1 GHz and 2.3 GHz radio-frequency bands(“Selection”); however, due to the broad scope of Regulation 20/2017, this edition of Indonesian Legal Brief will limit its discussion to the following matters:
