Through the enforcement of Regulation of the Minister of Communication and Informatics (“ Minister ”) No. 5 of 2020 , which was subsequently amended through the issuance of Regulation of the Minister No. 10 of 2021 (collectively referred to as “ Regulation 5/2020 ”), [1] electronic systems providers (Penyelenggara Sistem Elektronik– “ PSE ”) that operate User-Generated Content (“ UGC ”) platforms (“ PSE UGC ”) within the private sector [2] will be subject to the imposition of administrative sanctions upon failing to engage in access cutoffs (takedowns) of prohibited electronic information and/or electronic documents within determined timeframes.
