UGC-Based Digital Services Platform Must Ensure Protection from Copyright Infringement

Indonesia’s Constitutional Court (Mahkamah Konstitusi– “ MK ”) recently rendered Decision No. 84/PUU-XXI/2023 (“ Decision 84/2023 ”) in relation to a petition for a judicial review of Law No. 28 of 2014 on Copyright (“ Law 28/2014 ”) that was originally filed by PT Aquarius Pustaka Musik, PT Aquarius Musikindo and Melly Goeslaw (collectively referred to as “ Petitioners ”) on 30 July 2023.
