Victory for Holders of Copyrighted Written Works! Threshold for Secondary Use Licenses Set at 10%

The Minister of Law and Human Rights (“ Minister ”) has finally introduced a mechanism for the withdrawal, collection and distribution of royalties through secondary use licenses for books and/or other written works (collectively referred to as “ Works ”) through the issuance of Regulation on the Management of Royalties Through Secondary Use Licenses for Copyrighted Books and/or Other Written Works (“ Regulation 15/2024 ”), which has been in force since 19 June 2024. [1] This new framework has been under discussion since 2022 and its introduction has been endorsed in order to ensure legal certainty for individuals who engage in the duplication of Works. [2]
