The implementation of agrarian reform regulations is considered not yet optimal, despite being governed under Regulation of the President No. 62 of 2023 on Acceleration of the Implementation of Agrarian Reform (“ Perpres 62/2023 ”). Yulia Jaya Nirmawati, Director General of Agrarian Arrangement at the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (“ ATR/BPN ”), stated that the regulatory status under this Perpres is deemed less than optimal because it often conflicts with regulations in other sectors that are of equal or higher authority.

“The implementation of agrarian reform ideally needs to be supported by a strong regulatory framework. It seems that a new regulation is still needed,” said Yulia.

Yulia further emphasized the urgency of strengthening agrarian reform regulations due to its complex dimensions, ranging from the regulation of land rights, conflict resolution, recognition of indigenous communities, to cross-sectoral and cross-regional distribution for the government’s long-term programs. She stated that further regulatory measures related to agrarian reform are currently under consideration.

Meanwhile, to strengthen the regulations under the existing Perpres, Yulia confirmed that a revision of Regulation of the Minister (Permen)—which serves as a derivative regulation of the Perpres—is currently being drafted.

“It is still in the revision process,” she concluded.
