
AKPI Proposes Special Supervisory Judge for Bankruptcy Draft Bill

The Chairman of the Indonesian Curator and Management Association (Asosiasi Kurator dan Pengurus Indonesia/AKPI), Imran Nating, has proposed that the government appoint a Special Supervisory Judge in the drafting of amendment to Law No. 37 of 2004 on Bankruptcy and Suspension of Debt Payment Obligations (“ Law 37/2004 ”).
This was conveyed as input regarding cross-border insolvency. “A Special Supervisory Judge must be appointed to oversee the implementation of cross-border bankruptcy decision,” Imran told Hukumonline.
This appointment is considered important to ensure that the court fully understands the implementation mechanism of said decision and to guarantee that the bankruptcy decisions from abroad can be properly and lawfully executed in Indonesia.
The appointment of a Supervisory Judge with specialized expertise in international bankruptcy is expected to provide deeper and more effective oversight in cross-border cases.
