Gede Narayana, a member of the Central Information Commission, emphasized the need for the Draft Bill amending Law No. 14 of 2008 (“Law 14/2008”) on Public Information Disclosure (“KIP”) to be aligned with other laws to avoid overlap.
“Since the Public Information Disclosure Law must also be correlated with other laws,” said Gede, who also serves as Commissioner for Regulation and Public Policy.
Gede emphasized that the KIP Draft Bill must be consistent and aligned with Law No. 27 of 2022 on Personal Data Protection (“Law 27/2022”) and Law No. 1 of 2024 on the Second Amendment to Law No. 11 of 2008 on Electronic Information and Transactions (collectively referred to as “Law 11/2008”). This aims to address the current situation where many public bodies are confused about classifying information following the enactment of Law 27/2022.
Alignment with Law 11/2008 is necessary to ensure the optimal utilization of digital technology in fulfilling the right to information. Harmonization with Law 27/2022 is considered essential to provide public bodies with clear guidance on which information is open and which must be exempted for reasons of personal data protection.
