As Derivative of Draft Bill on Mineral and Coal Mining, the Ministry Prepares Regulation of the Minister of MSME.

The Ministry of Micro-, Small-, and Medium-scale Enterprises (Usaha Mikro Kecil dan Menengah– “ UMKM ”) is preparing a Regulation of the Minister (“ UMKM Regulation ”) as a derivative regulation of the Draft Bill (“ Minerba Draft Bill ”) on the Fourth Amendment to Law No. 4 of 2009 on Mineral and Coal Mining (“ Law 4/2009 ”). The Deputy for Medium-scale Enterprises at the Ministry of UMKM, Bagus Rachman, stated that the ministry is still awaiting the issuance of Regulation of the Government (PP) as the derivative from Minerba Draft Bill, which will serve as the basis for drafting the said regulation.

"As for mineral and coal mining, since it has already been mandated in the Law, we are still waiting for Regulation of the Government to be issued. From that Regulation of the Government, there will be a mandate to draft the UMKM Regulation," said Bagus to Hukumonline.

This UMKM Regulation will serve as the regulation governing the provisions for the granting of priority Mining Business License Areas for Minerals, Metals, and Coal, as stipulated in Article 51 paragraph (1) and Article 60 paragraph (1) of the Minerba Draft Bill.
