Assistance to Start Preliminary Investigation in RUU KUHAP

The government has almost completed the Problem Inventory List (Daftar Inventarisasi Masalah – “DIM”) of the Draft Law on the Criminal Procedure Code (Rancangan Undang-Undang tentang Kitab Undang-Undang Hukum Acara Pidana – “RUU KUHAP”). Minister of Law, Supratman Andi Agtas stated that the DIM will be completed this week, then it will be submitted to parliament.

The thing that is strengthened in the draft is the strengthening of human rights in the form of legal assistance. "We agree together that the assistance process by legal counsel can be provided at the preliminary investigation level," he said.

Currently, assistance is provided to suspects or defendants from the investigation level to the trial, the aim is to fulfill all the rights of the Suspect or Defendant.

In addition to the Indonesian National Police (Kepolisian Republik Indonesia – “Polri”), the Attorney General's Office, and the Supreme Court, the Ministry of Law also involved several other institutions to provide input on the regulatory framework. Among others are the Directorate General of Customs and Excise of the Ministry of Finance, the Ministry of Immigration and Corrections, and the Advocates Association.
