The Attorney General's Office is drafting the Attorney General's Guidelines on the handling of cases involving crimes related to the organization of Carbon Economic Value (“NEK”). This is a follow-up to the issuance of Regulation of the President No. 110 of 2025 (“Regulation 110/2025”) on the Organization of Carbon Economic Value Instruments and Greenhouse Gas (“GRK”) Emission Control.
Deputy Attorney-General for General Crimes (Jampidum) Asep N. Mulyana said that there are no regulations related to carbon trading crimes. However, there are a number of laws that can be used as a reference, such as the Criminal Code (“KUHP”), the Capital Market Law, and the Taxation Law.
“That is why this is a multi-pronged approach. With these guidelines, we can ensure that cases are handled simultaneously,” Asep told Hukumonline.
The Attorney General's guidelines on NEK crimes were developed in collaboration with the Ministry of Environment and civil society groups. The Attorney General's Office will also establish a task force and conduct training between prosecutors and investigators to ensure a shared understanding of carbon trading cases.
