Attorney Generals Office Issues Guidelines on Carbon-Related Criminal Violations

The Attorney General’s Office (Kejaksaan Agung– “ Kejagung ”) is currently formulating guidelines that will clarify administrative violations related to criminal acts in carbon trading. This effort is being carried out through the drafting of the Attorney General’s Guidelines on handling criminal cases related to carbon trading, as a follow-up to the issuance of Presidential Regulation No. 110 of 2025 (“ Perpres 110/2025 ”) on the Implementation of Carbon Economic Value (Nilai Ekonomi Karbon– “ NEK ”) Instruments and Greenhouse Gas (“ GHG ”) Emission Control.

“Law enforcement must clearly distinguish which actions involvemens reaand which are merely administrative violations. The Deputy Attorney General for General Crimes (Jampidum) is preparing guidelines on criminal acts in carbon trading,” said Asep Nana Mulyana, the Jampidum.

The guidelines will set out in detail the stages of prosecution, procedures for examining suspects, and the management of evidence. In addition, the Kejagung will also establish a task force (“ Satgas ”) and conduct training for Prosecutors and Investigators to strengthen a shared understanding of carbon trading cases, as their characteristics will differ from conventional criminal cases.
