
Awaiting the Public Procurement Draft Bill, Regulation 46/2025 Bridges Government Procurement

National Public Procurement Agency (Lembaga Kebijakan Pengadaan Barang/Jasa Pemerintah - “LKPP”) will make a number of amendments to the Draft Bill on Public Goods and Services Procurement (Pengadaan Barang dan Jasa Publik - “PBJ Draft Bill”). This follows the issuance of Regulation of the President No. 46 of 2025 (“Regulation 46/2025”) on the Second Amendment to Regulation of the President No. 16 of 2018 on Government Goods/Services Procurement (“Regulation 16/2018”).
“Actually, we have been working on both the draft bill and the draft regulation of the government (“Draft Regulation”) related to the procurement of goods and services. However, because the political aspect of the draft bill is certainly high, the bridging will use a presidential regulation,” said the Director of Strategy and Policy Development for General Procurement at LKPP, Emin Adhy Muhaemin, to Hukumonline.
Based on Regulation 46/2025 obtained by Hukumonline, there are several changes, including new definitions and provisions. One of these relates to special regulations for procurement funded by foreign loans or grants, as well as industrial products declared as Domestic Products (self-declared).
“Of course, there are many changes because the PBJ Draft Bill is still being delayed. We are waiting for the invitation to discuss it, which has not been issued yet,” said Emim.
