
Barantin Drafts Regulation on State-Controlled Carrier Media Commodities

The Indonesian Quarantine Agency (“Barantin”) is currently drafting a Regulation of the Agency/Institution of the Indonesian Quarantine Agency on Procedures for Determining Carrier Media as State-Controlled Assets. The regulation will update the provisions governing Carrier Media that are under State Control, as mandated by Law No. 21 of 2019 on Animal, Fish, and Plant Quarantine (“Law 21/2019”).
“This Agency Regulation is designed to establish binding deadlines, enabling Quarantine Officials to firmly determine their status as ‘State-Controlled’ for the purposes of national biosecurity and the smooth flow of goods,” an internal Barantin source told Hukumonline.
The regulation will be coordinated across ministries/agencies to prevent overlap with the provisions on Unclaimed Goods (Barang Tidak Dikuasai – “BTD”) and Goods Under State Control (Barang Dikuasai Negara – “BDN”) administered by the Directorate General of Customs and Excise (Ditjen Bea dan Cukai – “DJBC”). This will include mandatory destruction where commodities are proven to be infected with hazardous Quarantine Animal Pests and Diseases (“HPHK”), Quarantine Fish Pests and Diseases (“HPIK”), or Quarantine Plant Pests Organism (“OPTK”), or where the commodities are rotten or pose a threat to the environment.
