BKPM Revises Regulation 5/2025 to Improve Micro-Scale Enterprises Regulations

Ministry of Investment and Downstream Industry/Investment Coordinating Board (“BKPM”) plans to revise Regulation of the Minister of Investment and Downstream Industry/Head of BKPM No. 5 of 2025 (“Regulation 5/2025”) on Guidelines and Procedures for the Implementation of Risk-Based Business Licensing and Investment Facilities through the Electronically Integrated Business Licensing System (Online Single Submission (“OSS”). The changes are made to aspects of micro-scale enterprises that are considered to be out of step with the dynamics in the field.

“We will make minor changes to the micro-scale enterprise aspect, because it is impossible to amend Regulation of the Government No. 28 of 2025 . So, the most feasible option is for us to revise it at the ministerial regulation level," said the Deputy for Investment Climate Development at BKPM, Riyatno, to Hukumonline.

The dynamics of implementing risk-based policies and electronic licensing systems have given rise to a number of technical issues. Previously, BKPM had issued a circular that was valid for three months as a temporary solution to overcome obstacles in the field.

“We are striving to complete it in the first half of this year,” he explained.
