Creative Economy Ministry Accelerates Revision of Presidential Regulation on National Game Industry

The Ministry of Creative Economy (“Ekraf”) is currently finalizing the drafting of the Draft Presidential Regulation on Amendments to Presidential Regulation No. 19 of 2024 (“Perpres 19/2024”) on the Acceleration of the Development of National Game Industry (“RPerpres”). The revision initiative was undertaken in response to market dynamics, which remain heavily dominated by foreign products, while also aiming to harmonize regulations across various sectors.

“One of the matters being discussed is strengthening the substance of the main provisions of the Presidential Regulation, including coordination mechanisms, labor protection, and the empowerment of regional ecosystems,” stated Moch. Nurul Huda, Head of the Legal, Human Resources, and Organizational Bureau (Hukum, Sumber Daya Manusia, dan Organisasi – “HSDMO”) of the Ministry of Creative Economy.

One of the key legal frameworks in the draft amendment relates to access to Intellectual Property (“IP”)-Based Financing. Under the proposed framework, financing schemes will be directed toward enabling intangible assets, such as game copyrights, to be optimally utilized as collateral or as objects of financing. This initiative represents a continuation of the implementation mandated under Government Regulation No. 24 of 2022 on the Implementing Regulation of Law No. 24 of 2019 on the Creative Economy (“PP 24/2022”).

“The draft is still under discussion at the Inter-Ministerial and/or Inter-Non-Ministerial Committee Meeting (“PAK”),” he added.
