Danantara Calls for Tax Incentives to Streamline BUMN

The Daya Anagata Nusantara Investment Management Agency (“BPI Danantara”) is urging the Government to promptly finalize a number of implementing regulations under the new State-Owned Enterprises (“BUMN”) Law. One of these is the Draft Regulation of the Government on Tax Treatment, which is intended to govern special tax treatment or adjustments to tax tariffs and tax facilities for transactions involving asset consolidation, restructuring, and investment within the BUMN sector.

“One of the important matters is RPP on tax facilities, as it would provide incentives for transactions between BUMN that are aligned with the streamlining program,” said Inosentius Samsul, Senior Director of Legal Asset Management at BPI Danantara, to Hukumonline.

Accordingly, the implementation of each corporate action undertaken as part of the streamlining program can be better facilitated. This is particularly relevant given that the streamlining of BUMN is being carried out to strengthen state-owned companies, as stipulated in Directive of the President No. 7 of 2026 on the Acceleration of the Streamlining Program for BUMN and/or Subsidiaries of BUMN (“Inpres 7/2026”) and Regulation of the President No. 68 of 2026 on the Designation of the BUMN and Subsidiaries of BUMN Restructuring Program as a National Strategic Project.

“So, the provisions of Law No. 1 of 2025 and Law No. 16 of 2025 still need to be followed up by finalizing the RPP. We hope this can be done as soon as possible, as its implementation is scheduled to commence in 2027,” he concluded.
