Details of the Revision to the Regulation of the Minister on Land Acquisition

The government is currently revising Regulation of the Minister of Agrarian Affairs and Spatial Planning/National Land Agency (“ATR/BPN”) No. 19 of 2021 on the Implementation Provisions of Regulation of the Government No. 19 of 2021 on the Implementation of Land Acquisition for Development in the Public Interest (“Regulation 19/2021”). This revision aims to integrate the Social Impact Assessment (“SIA”) as an additional component in the Land Acquisition Planning Document (“DPPT”).

“These guidelines have been integrated into the amendments to Regulation 19/2021. During the planning stage, it becomes an additional component in the land acquisition planning document or DPPT,” said Yuliana, Director of Land Valuation and Land Economy at the Ministry of ATR/BPN.

Furthermore, Yuliana explained that the integration of the SIA into the DPPT aims to ensure that social risks are identified from the outset and accompanied by adequate mitigation plans. In this revision, the DPPT is also strengthened by the addition of new elements, including the Social Impact Management Plan (“RPDS”) to mitigate negative impacts and optimize the benefits of development.

Additionally, this revision incorporates the principle of “information upfront” to ensure community participation, particularly that of indigenous communities. A livelihood restoration aspect has also been added to mitigate impacts, including assistance to restore livelihoods lost due to the project, such as those of small traders and communities who have lost access to natural resources.
