The government plans to revise Law No. 14 of 2008 on Public Information Disclosure (“UU 14/2008”). One of the issues highlighted is the issue of disputes.
“Karena penyelenggara layanan tidak hanya mengurus itu (sengketa). Jadi menghabiskan waktu dan energi. Because service providers do not only handle that (disputes). So it takes time and energy. So one of the inputs is that the mediation process needs to be optimized,” said the said the Head of the Public Information Facilitation and Complaints Division of the Ministry of Home Affairs (Kementerian Dalam Negeri – “Kemendagri”), Rega Tadeak Hakim to Hukumonline.
A public information disclosure dispute is a dispute between a public agency and an applicant or user of public information regarding the right to obtain and use information.
Rega believes that mediation can be carried out first rather than adjudication, and is considered more effective in resolving the problem. “Mediation is very productive and communicative. The applicant also understands the difficulties of the public agency,” continued Rega.
