The Directorate General of Intellectual Property (Direktorat Jenderal Kekayaan Intelektual– “ DJKI ”) of the Ministry of Law (“ Ministry ”) is finalizing the Draft Regulation of the Minister (“ Draft Regulation ”) on Patent Applications. Among other things, it addresses procedures to change a simple patent application into a regular patent, and vice versa.
“The goal is to provide flexibility for patent applicants who wish to change the status of their application, making it easier to accommodate evolving innovation needs,” said Andriensjah, Secretary of DJKI to Hukumonline.
In addition, the earlier substantive examination aims to accelerate the evaluation process of patent applications, ensuring that granted patents truly meet the requirements and do not hinder industrial and technological development. Patent applicants are also given the opportunity to withdraw their applications, if necessary, for example, when they encounter technical issues or make other strategic decisions during the patent filing process.
“It is still being discussed, article by article, to refine the content of the regulation among the relevant ministries and agencies,” he concluded.
