DJKI Updates the Substance of the RUU Industrial Design

The Ministry of Law, through the Directorate General of Legislation (Ditjen PP), is following up on the substance updates related to the Draft Bill (Rancangan Undang-Undang – “RUU”) on the Amendment to Law No. 31 of 2000 on Industrial Design (“Industrial Design Law”). The inventory of new substances that will be included in the Draft Industrial Design Law includes improvements to the examination mechanism, digital transformation, and the utilization of artificial intelligence (AI).

There are several substantive updates. One of them involves the removal of article clause related to [prior users] to enhance legal certainty for industry players,” said an official from the Directorate General of Intellectual Property (DJKI) of the Ministry of Law and Human Rights to Hukumonline.

This relates to general provisions on the protection and application of Industrial Design Rights (Hak Desain Industri/HDI), industrial design examination, and industrial design certification, as well as the extension of HDI protection. In addition, new substances in the RUU DI include appeal examinations through the industrial design appeal commission, which involves alignment with international agreements such as the Geneva Act of the Hague Agreement Concerning the International Registration of Industrial Designs 1999 (“Hague Agreement 1999”). It also introduces government responsibility for HDI as a fiduciary object.

“A more comprehensive alignment is still being carried out,” he added.
