DPR Calls on Government to Revise LSD and LP2B Regulations

Commission II of Indonesia’s House of Representatives (“DPR”) has called on the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (“ATR/BPN”) to revise the regulations on Protected Agricultural Land (Lahan Sawah Dilindungi - “LSD”) and Sustainable Food Agricultural Land (Lahan Pertanian Pangan Berkelanjutan - “LP2B”). Chairperson of Commission II of DPR RI, Muhammad Rifqinizamy Karsayuda, stated that the revisions are necessary to ensure that the regulation of LSD and LP2B is more measurable and consistently applied at the national level.

“We call on the Ministry of ATR/BPN to evaluate the regulations on LSD and LP2B so that they are aligned with food-producing agricultural land, spatial planning certainty, and development needs, while continuing to ensure national food security without hindering development and investment projects already underway in the regions,” said Rifqi.

The request was made after Commission II received complaints from several regional heads regarding delineation issues that were considered inaccurate. As a result, certain productive agricultural land was not included within LP2B areas. In addition, the integration of LP2B into spatial plans was considered not yet fully aligned.

Rifqi said that regional heads had also raised concerns over the sudden designation of LSD on land that had already been planned for investment development. According to him, such circumstances could disrupt investment in the regions.

“For example, a developer may have already planned to develop the area and may have engaged with a bank regarding financing, only for the area to suddenly be designated as LSD. That creates a problem,” he said.
