DPR Speeds UP Discussion of Draft Bill on Anti-Monopoly

The House of Representatives of the Republic of Indonesia (Dewan Perwakilan Rakyat Republik Indonesia – “DPR RI”) will revise Law No. 5 of 1999 on the Prohibition of Monopolistic Practices and Unfair Business Competition, as amended by Regulation of the Government in Lieu of Law No. 2 of 2022 on Job Creation (collectively referred to as “UU 5/1999”). Deputy Chairman of Commission VI of DPR RI, Nurdin Halid said that the Working Committee (Panitia Kerja/Panja) is currently preparing the Academic Script of the Draft Bill (Rancangan Undang-Undang – “RUU”) on Anti-Monopoly.

“This is currently in the stage of obtaining information from all stakeholders for the preparation of the Academic Script,” he told Hukumonline. The process of receiving input in the preparation, said Nurdin, involved a number of related Ministries and Institutions.

In the revision of UU 5/1999, Nurdin emphasized that natural resources for the benefit of the people should not be considered a monopoly, but must be consolidated by the state. In addition, regarding the institutional aspect of the Business Competition Supervisory Commission (Komisi Pengawas Persaingan Usaha – “KPPU”), according to him, its authority needs to be strengthened to be in accordance with current modern conditions.

Nurdin is confident that the discussion on the revision of UU 5/1999 can be completed quickly considering that this change has been included in the 2025 National Legislation Program.  “InshAllah it will be completed this year," he added.
