
Draft Bill on Nuclear Energy Regulates the Establishment of Nuclear Promotion Agency

The Nuclear Energy Regulatory Agency (“ BAPETEN ”) stated that the proposal to reinstate the National Nuclear Energy Agency (“ BATAN ”) is one of the points being discussed in the Draft Bill on Amendment (“ Draft Bill ”) to Law No. 10 of 1997 on Nuclear Energy, as amended by Regulation of the Government in Lieu of Law No. 2 of 2022 on Job Creation (collectively referred to as “ Law 10/1997 ”).
“There has indeed been discussion on this matter due to the perceived urgent need,” said the Head of the Legal, Cooperation, and Public Communication Bureau of BAPETEN, Ishak, to Hukumonline.
According to Ishak, the reinstatement of the agency is based on the necessity to establish a promotional body focused on nuclear research and technology development. This agency will be responsible for ensuring that nuclear energy can be implemented to encourage broader utilization.
He explained that the functions would be separated from the nuclear oversight functions currently carried out by Bapeten. However, oversight of nuclear energy utilization will continue to be conducted to ensure compliance with safety, security, and safeguards standards.
“Because promotion and oversight must be separated; there should be no conflict of interest,” he added.
