The Draft Government Regulation on the Implementation of Law No. 20 of 2025 on the Criminal Procedure Code (“Draft GR on the Implementation of KUHAP”) will regulate time limits for the return and completion of case files. Director General of Legislation at the Ministry of Law Dhahana Putra stated that these provisions are still under discussion before the Draft GR is finalized.
“First, regarding the time limits, including how the return process will be carried out. There will be time limits, as the previous KUHAP did not impose any,” Dhahana told Hukumonline.
The imposition of time limits for the return and completion of case files aims to prevent the repeated back-and-forth transfer of case files during criminal proceedings. Dhahana explained that these provisions form part of the coordination mechanism between investigators and public prosecutors, which remains under discussion in the Draft GR on the Implementation of KUHAP.
He further stated that his ministry will soon hold a high-level meeting involving the Supreme Court, the Attorney General's Office, the Indonesian National Police, and the Ministry of Immigration and Corrections.
